Misty and Sams Cash Terms Of Service
By signing up and actively using the Misty and Sams Cash program you agree to all terms and conditions set forth in this agreement. Misty and Sams Cash may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with Misty and Sams Cash. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Misty and Sams Cash program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
Responsibility of Members:
When you sign up with this program, you agree to keep all Admin Emails and/ or Admin Messages or other “inside” information to yourself as private. You may not reproduce in any form the contents of this information without the express written consent of Misty and Sam's Cash. This policy works the same if you sign a loan contract. We are sure you would not publicly post your personal or private information from that contract in public forums or share them with friends.
Misty and Sam’s Cash Admin Messages do include information for the sole purpose of informing its members of changes in procedure, policy or administration. They can also include more personal information including, but not limited to, lists of programs, members and events. Some may even include member appeals or congratulatory messages. However, most importantly, Admin Messages are for members primarily.
Announcements, on the other hand, are “good to go” for public consumption -- like news and announcements posted on public pages as they are posted on our Terms, Help, Privacy Policy and Home pages.
This is not a “gag order” but a set policy the same as any company should have. The change in terms we have posted reflects only the consequences to members that violate this agreement. If any “outside” person contacts you asking for privileged information such as that contained in our or Admin Emails or Admin Messages, then you should tell them this: they will have to sign-up to get it.
You must be 13 years of age or older to participate in this program. Our program is open to both US and International members and is void where prohibited by local governing laws.
You agree to and must use your own name, address and email address in the sign-up process and may not assume a false identity. You must provide your full name and full mailing address. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing Misty and Sams Cash account.
Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Multiple accounts using the same IP, computer Id#, payout info, email address, mailing address, name, etc., are grounds for termination and loss of any/all earnings involved in all related accounts unless written permission has been granted from current admin.
You will use your email address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link. We strongly advise not to use the same password on different websites.
You are solely responsible for any and all use of your Misty and Sams Cash account including authorization by you to any third party individual who may use your account.
Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Misty and Sams Cash be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. Members sending abusive emails to the site will have their accounts suspended. We do not tolerate any abuse or harrassement to admin, staff or other members.
If you hit a 'cheatlink', the (minus)amount of the cheatlink will be deducted from your account. If your account shows you hit a cheatlink, the funds will NOT be refunded. Any cheatlink will either be a hidden link (that the naked eye cannot see and intended for bots) or will be a clearly marked entirely visible link. If your account shows you hit a (bot)cheatlink your account will be suspended.
You must maintain your e-mail account that you used when signing up with Misty and Sams Cash. You agree to receive e-mail advertising from Misty and Sams Cash.
In the event your e-mail account on file becomes closed or blocked to messages from Misty and Sams Cash, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately. Members are not allowed to bookmark account pages such as paid2click pages etcetera, these pages are changed often and will therefore become invalid pages. Members found clicking on pages through bookmarks will be suspended. Misty and Sams Cash does not allow the selling of accounts, referrals or redeemed advertising without prior written consent, members found selling either ads, referrals or accounts are having their account terminated. Accounts are suspended after inactivity for 30 days, accounts in vacation mode will be deleted after 35 days. Members with obvious invalid information, such as but not limited to N/A as address, the ip tracing back to china but the account says USA, or members with profiles that are not in english and thus are not readable to us will have their account terminated
Relationship of the Parties:
You and Misty and Sams Cash are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Misty and Sams Cash. You understand that you do not have authority to make or accept any offers or make any representations on behalf of Misty and Sams Cash. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.
Limitation of Liability:
Misty and Sams Cash will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Misty and Sams Cash program, even if Misty and Sams Cash has been advised of the possibility of such damages. Furthermore, Misty and Sams Cash aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.
Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by Misty and Sams Cash. Members will earn a percentage of advertising revenues collected by Misty and Sams Cash. Members will be paid via PayPal / eGold (10% Processing Fee), Misty and Sams Cash will pay members when their balance reaches the minimum payout rate set by Misty and Sams Cash and they use the redeem feature to request payment. Payments of earnings made after October 1st 2006 are made within 20 days or a reasonable time after.
Spam:
You may not promote us through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Misty and Sams Cash and may result in legal prosecution. Misty and Sams Cash strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. Misty and Sams Cash may charge up to $5 per spam email sent.
